Jurist says alleged war criminal shouldn’t have been freed
An Italian jurist has showed that the release of alleged Libyan war criminal al-Masri was either a misunderstanding or a deliberate political act by Rome.
According to Sistema Penale and WSWS, jurist Aniello Nappi said that Italian authorities could have still kept al-Masri in custody, despite errors in the warrant and no permission from the Minister of Justice.
He says the confusion arose with the Rome of Court of Appeal who was tasked with approving the arrest warrant, and who ignored a special provision in Italian law which, in emergency situations, where the International Criminal Court has requested the arrest, the immediate detainment of a person is allowed.
